THE CORPORATION OF THE TOWNSHIP OF LAIRD
By-law Number 955-14
Being a By-law to govern the size, placement and payment of culverts in ditches within the Township of Laird.
WHEREAS it is necessary for land owners to have culverts in township ditches to provide for entrances to their property;
AND WHEREAS it is necessary to require the appropriate size and standard to allow for proper drainage;
BE it resolved that all culverts installed in ditches on township property shall be new, or used, provided the approval of the Road Superintendent or his/her delegate is obtained prior to installation;
AND all installations shall be made by the Township of Laird to assure appropriate placement to allow for proper drainage;
AND the Road Superintendent, or his/her delegate, shall determine the size.
AND any culvert required to be over 600mm (24″) in diameter shall be subsidized by the municipality for the cost above 600mm (24″) in size.
BE it further resolved that anyone who contravenes any provision of this by-law shall be liable to a penalty equal to the cost of removing and/or replacing the offending culvert.
Such costs if unpaid within 30 days of billing, shall be added to the tax roll and collected as taxes.
If a property owner disagrees with the decision of the Road Superintendent or his/her delegate, that property owner shall communicate his/her concerns and objects, in writing, to the Council of the Township of Laird, outlining such items as are pertinent to the subject.
Council shall consider the matter and report its decision to the property owner.
By-law 640-87 is hereby rescinded.
