THE CORPORATION OF THE TOWNSHIP OF LAIRD

By-Law No. 969-15

BEING a by-law to regulate the operation of off-road vehicles on highways in the Township of Laird.

WHEREAS the Highway Traffic Act, Ontario Regulation 135/15 and Ontario Regulation 316/03 authorizes Councils of local municipalities to pass by-laws regulating, governing or prohibiting the operation of off-road vehicles within the municipality including any highways therein or any part or parts thereof;

THEREFORE the Council of the Corporation of the Township of Laird ENACTS AS FOLLOWS:

    1. All off-road vehicles are permitted to be operated on any highway within the municipality that is under the jurisdiction of the municipality, or on any part or part of such highway in accordance with Ontario Regulation 135/15 and O. Reg. 316/03
    2. An off-road vehicle shall not be operated on a highway unless it meets the requirements of Section 7 to 15 of O. Reg. 135/15 and it is operated in accordance with sections 16 to 24. O. Reg. 316/03, s. 6.
  1. “all-terrain vehicle” means an off-road vehicle that,

    1. has four wheels, the tires of which are all in contact with the ground,
    2. has steering handlebars,
    3. has a seat that is designed to be straddled by the driver, and
    4. is designed to carry,
      1. a driver only and no passengers, or
      2. a driver and only one passenger, if the vehicle,
        1. has one passenger seat that is designed to be straddled by the passenger while sitting facing forward behind the driver, and
        2. is equipped with foot rests for the passenger that are separate from the foot rests for the driver;

    “multi-purpose off-highway utility vehicle” means an off-road vehicle that,

    1. has four or more wheels, the tires of which are all in contact with the ground,
    2. has a steering wheel for steering control,
    3. has seats that are not designed to be straddled, and
    4. has a minimum cargo capacity of 159 kilograms;

    “off-road vehicle” has the same meaning as in the Off-Road Vehicles Act.

    “recreational off-highway vehicle” means on off-road vehicle that,

    1. has four or more wheels, the tires of which are all in contact with the grounds,
    2. has a steering wheel for steering control,
    3. has seats that are not designed to be straddled, and
    4. has an engine displacement equal to or less than 1,000 cubic centimeters;

    “seatbelt assembly means a device of assembly composed of a strap or straps, webbing or similar material that restrains the movement in order to prevent or mitigate injury to the person. O. Reg. 316/03, s. 1; O Reg. 135/15 s. 1.

  2. Any person operating an off-road vehicle in contravention of this by-law shall be guilty of an offence, and subject to the penalties applicable by law.
  3. By-law Number 821-03 is hereby rescinded.
  4. This by-law shall become effective July 1, 2015.
